Anti-spam Policy – Sidemail.io

This Anti-spam Policy forms part of the Terms of Service between you and Avantis Innovations LLC (“Company,” “we,” “us,” or “our”). It applies to every email or other communication sent through the Sidemail.io service (“Sidemail”).

No tolerance for spam

Sidemail is a permission-based email service. You may not use Sidemail to send spam, unsolicited marketing email, or communications that recipients do not reasonably expect.

You are responsible for every message sent through your Account, including messages sent by your employees, contractors, customers, integrations, applications, API keys or other authorized users.

Compliance with applicable law alone does not necessarily satisfy this Policy. We may impose stricter requirements to protect recipients, our infrastructure, sending reputation and other customers.

Permission and recipient relationships

  1. You may send marketing or promotional email only to recipients who have affirmatively requested or consented to receive that type of email from you.

  2. You must be able to provide reasonable evidence of permission, including where appropriate:

    1. the recipient’s email address;
    2. the date and method of signup;
    3. the source form, page or application;
    4. the language shown when permission was obtained; and
    5. relevant confirmation, IP address or consent records.
  3. Permission must be specific to you or the organization you are authorized to represent. Permission given to another company, website, list owner or unrelated affiliate does not automatically permit you to email the recipient.

  4. You may send lawful transactional or relationship messages where the recipient has an existing relationship with you and the message is expected and necessary for the relevant transaction or service. You must not disguise marketing content as a transactional message.

  5. If a recipient has opted out, withdrawn consent, objected to marketing or otherwise requested no further contact, you must not send that recipient further marketing email.

Cold email is prohibited

You may not use Sidemail to send cold marketing or sales email to recipients who have not affirmatively requested or consented to receive it.

This prohibition applies even where unsolicited business-to-business email might otherwise be permitted under a particular law. Sidemail is not a cold-email platform.

You may not attempt to avoid this restriction by describing unsolicited messages as networking, partnership outreach, recruitment, lead generation, account-based marketing, business development, introductions or similar communications.

Prohibited lists and collection methods

You may not send to or import recipient information obtained from:

  1. purchased, rented, leased or traded lists;
  2. scraped, harvested, crawled or copied websites, directories, social networks, public filings or search results;
  3. data brokers, enrichment providers or lead databases where each recipient did not specifically consent to receive your emails;
  4. guessed, generated, appended or automatically constructed email addresses;
  5. another customer, business, employer, affiliate or third party without valid permission covering your use; or
  6. lists whose source, age, permission status or accuracy you cannot reasonably verify.

Public availability of an email address is not permission to send marketing email.

Message and sender requirements

Every message must:

  1. comply with applicable privacy, electronic-communications, consumer-protection, marketing and anti-spam laws;
  2. use accurate and non-misleading sender, domain, routing, reply-to and header information;
  3. use a subject line that accurately reflects the message;
  4. clearly identify the person or organization responsible for the message;
  5. include a valid physical postal address where required by law;
  6. identify advertising or promotional content where required by law;
  7. contain a clear and functioning unsubscribe method for marketing email;
  8. comply with authentication and technical requirements that apply to the sender, including SPF, DKIM, DMARC and list-unsubscribe requirements where applicable; and
  9. avoid deceptive design, impersonation, hidden content, malicious links, malware or attempts to evade filtering and reputation systems.

You may not use a domain, identity, brand or sender address without authorization.

Unsubscribes and suppression

  1. You must make unsubscribing easy, free and reasonably immediate. You may not require a recipient to log in, provide unnecessary information or complete unrelated steps.
  2. You must process opt-outs promptly and within any shorter period required by us, an inbox provider or applicable law.
  3. You may not remove, bypass, alter or ignore suppression mechanisms provided through Sidemail.
  4. We may automatically suppress recipients associated with opt-outs, complaints, hard bounces, blocklists, abuse reports or other risk signals.
  5. You may retain only the information reasonably necessary to maintain a suppression record and prevent the recipient from being contacted again.

Sending reputation

You must maintain healthy sending practices and promptly remove invalid, inactive, unengaged or complaining recipients.

Unless we specify stricter limits for your Account, sending stream or provider:

  1. your bounce rate must remain below 7%; and
  2. your spam complaint rate must remain below 0.1%.

These figures are maximum enforcement thresholds, not recommended targets. We may apply lower thresholds, different measurement periods or additional reputation criteria based on sending volume, Account history, recipient-provider requirements, spam traps, blocklists, delivery failures, unusual activity or risk to Sidemail.

For Accounts with low sending volume, we may use a different or longer measurement period so that a small number of events does not produce a misleading rate.

Monitoring and verification

To protect Sidemail and recipients, we may:

  1. monitor delivery events, bounces, complaints, suppression events, unusual sending patterns and other reputation signals;
  2. review message metadata and, where reasonably necessary to investigate abuse or comply with law, message content;
  3. request information showing how recipients were collected and how permission was obtained;
  4. require you to pause a campaign, clean or reconfirm a list, change sending practices, authenticate a domain or complete another remediation step;
  5. limit sending volume, recipients, domains, features or Account access; and
  6. cooperate with inbox providers, blocklist operators, regulators, law enforcement and affected third parties where reasonably necessary.

Failure to provide requested evidence or cooperation may itself result in restriction, suspension or termination.

Suspension and termination

We may immediately restrict, suspend or terminate an Account or sending activity if we reasonably believe that:

  1. you violated this Policy, the Terms of Service or applicable law;
  2. your activity creates a security, legal, deliverability or reputation risk;
  3. your bounce, complaint or other reputation metrics are unacceptable;
  4. you provided inaccurate information about recipient permission or list sources;
  5. your Account was compromised or is being used without authorization; or
  6. immediate action is requested by an inbox provider, infrastructure provider, regulator, law-enforcement authority or other competent party.

We may act without prior notice where immediate action is reasonably necessary. Fees are non-refundable to the extent stated in the Terms of Service.

You are responsible for third-party fees, fines, penalties, claims and reasonable investigation, remediation, collection and legal costs arising from your violation of this Policy, as provided in the Terms of Service.

Changes and contact

We may update this Policy from time to time. Material changes will be communicated as described in the Terms of Service.
